  • Welcome to Fix-a-Foto.com! (herein referred to as “we”, “us”, or “Fix-a-Foto.com”).
  • If you do not agree to these Terms & Conditions, please do not use our website/services.
  • Fix-a-Foto.com has the right to refuse any and all current or future use of our services.
  • We reserve the right to change our terms, rates and fees at any time, for any reason whatsoever.
  • We at Fix-a-Foto.com reserves the right to terminate the access of any person to the system, with or without cause.
  • Fix-a-Foto.com will report any unlawful use of its system to authorities and will prosecute unlawful conduct fully to the law.
  • Important Note About Copyright:
  • Sending a file using our services constitutes an AGREEMENT. By you that you are familiar with the copyright laws, and you agree to defend and indemnify any liability arising. Be it from our performing the requested activities at your request, regardless of legal theory, including violation of statute, our negligence, your breach of this agreement, or otherwise.
  • Fix-a-Foto.com will not be liable for any damages of any kind arising from the use of this site and/or our services.
  • You may not use a false e-mail address, impersonate any person or entity.
  • You agree to not use our services to upload, post, email, transmit or otherwise make available any content that is unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libelous, invasive of another´s privacy, hateful, or racially, ethnically or otherwise objectionable.
  • We don’t create people impersonations by manipulating nude or erotic pictures.
  • The Customer shall not exhibit any expressions of abuse, offensive language or images showing child abuse. Child pornography,  pictures of minors engaged in sexual conduct  other sexual situations will reported  to the police.
  •  The download or upload of material through our systems is done so at your own risk.  The customer will be solely responsible for any loss or damage to files, furthermore  damage to your computer system including loss of data that may result in the download or upload of any material.
  • You agree that all billing or shipping information that you submit is accurate.
  • We do not provide prints but a restored digital file, however prints may be ordered, as a result see price list
  • Price list is based on files up to 3600 x 2400 pixels saved in JPG format.
  • Please always review order prior to confirmation. Cancellations are only accepted within 24 hours of placing the order. After this period is over, your order is processed and will no longer be cancelled.
  • About Instructions, Re-works and/or Refunds
  • Fix-a-Foto.com will perform to its Customers instructions. The Customer is fully responsible for final verification and approval. Your submitted order to the restoration process is agreeing that you accept responsibility for any errors therein.
  • If Fix-a-Foto.com fails to perform clearly-requested instructions, we will re-work the image. Requesting a retouch due to something not mentioned in the instructions, asking to re-open a closed order is classed as a “New Instruction.”  This will incur extra costs.
  • We reserve the right to charge extra cost from the fourth and subsequent re-work requests. If the order was estimated as “Retouch” or “Not Recommended” we reserve the right to charge extra cost from the second and subsequent re-work requests.
  • Fix-a-Foto.com will not make a refund an order unless unable to complete the work in accordance with the Customer´s clear and complete instructions.
  • The determination on whether Fix-a-Foto.com has complied with Customer instructions is made by the CEO of the company.
  • We do not refund, nor make a reduction on orders that a Customer failed to be downloaded within that set time.
  • Fix-a-Foto.com will not make refund on orders that were estimated as “Severe”, “Extreme”, “Not Recommended”.Nor will on orders that are unsatisfactory as a result of its Customer´s failure to include clear and complete instructions. Orders that reached a third re-work request, by receiving a low resolution file, and/or by receiving a blurred/out of focus photo.
  • Privacy
  • The information that you provide is only used to identify you as a client .
  • Your personal data will not traded
  • We do not accept orders from customers under 13 years.  Should we discover data sent by a minor, it will be in order to protect your privacy. We also encourage parents to be active participants with their child’s activities online.
  • Our site uses a secure server.
  • We outsource online payment services to PayPal, therefore  have no access to your credit/debit card information. We do not store your credit card information.
  • Fix-a-Foto.com is a highly secure system. We use encryption technology to protect passwords and registration information during their transfer over the Internet. However, owing to the global nature of the Internet, no data transmission 100% secure. We do strive to protect your photos and personal information.  We will not,  however, ensure or warrant the security of any information you transmit to or from us. You do this at your own risk.
  • These Terms & Conditions may change from time to time, therefore please check back periodically.
